§ 721-43. Excavations Near Street.

  • In all cases in which the construction, repair or alteration of any building or other structure will require an excavation within three feet of the curb line of any street, permits must be obtained from the department before the excavating is commenced. Such permits shall be similar to those issued for street openings, and applications therefor must be accompanied by deposits based on the estimated cost of restoring the street in case of settlement, using the schedule of prices fixed for street openings.

    In cases where the edge of the excavation is more than three feet from the curb line, the city manager shall, at the first indication of any settlement in the street surface or curbing, require the builder to obtain a street opening permit from the department and shall have the right to suspend or cancel the building permit until the street opening permit has been issued.
