No person, firm or corporation shall make an opening in any street, or disturb in
any way, the surface or subsurface of any street or sidewalk, without having first
received a permit therefor from the department. Where, because of a leak in a water

the public safety requires immediate action, the work may be proceeded without previous
permit, but the permit shall be obtained as soon after the accident as possible.
