§ 721-41. Street Opening Without Permit Unlawful.

  • No person, firm or corporation shall make an opening in any street, or disturb in any way, the surface or subsurface of any street or sidewalk, without having first received a permit therefor from the department. Where, because of a leak in a water or gas main, a break in an electric duct, a broken rail, or other serious accident, the public safety requires immediate action, the work may be proceeded without previous permit, but the permit shall be obtained as soon after the accident as possible.
