§ 723-24. Bike Share Stations.

  • (a)

    No person shall obtain a revocable street privilege from the city for the placement of bike share stations in the right-of-way unless the following conditions have been met:

    (1)

    That person has submitted a timely and complete response to a city-issued request for proposals for a bike share system operator; and

    (2)

    The city selected that person's response to the request for proposals for a bike share system operator as the "most advantageous" to the city; and

    (3)

    That person has obtained the insurance required in Section 723-24(b)(4)(iv); and

    (4)

    That person has executed a concession agreement with the city for the operation of a bike share system within the city.

    (b)

    The city manager or his designee is authorized to grant revocable street privileges for the placement of bike share stations in the right-of-way subject to the following restrictions:

    (1)

    Bike share stations may be located:

    (i)

    Only on paved surfaces;

    (ii)

    In a location that is not directly in front of an entrance to a building;

    (iii)

    In a way that does not block access to buses, bus stops, fire escapes, sidewalk access doors, traffic or street lighting equipment, utility valve boxes or other utility equipment; and

    (iv)

    In a way that does not obstruct permanent building signage or building display windows (unless prior permission from the property owner has been obtained).

    (2)

    No advertising may be displayed upon bike share stations; provided, however, that the name, logo, and contact information of the owner, operator, donor, sponsor, or any combination of the above may be displayed on the bike share kiosk using placards, decals, vinyl wraps, or similar methods, so long as the size of the sponsorship display does not exceed the overall dimensions of the kiosk. In addition, if the bike share station includes a map module, the name and logo of the owner, operator, donor, sponsor, or any combination of the above may be displayed on one side of the map module which may be no larger than six hundred forty-eight (648) square inches. The name and logo of the owner, operator, donor, sponsor, or any combination of the above may be displayed on the other side of the map module which may be no larger than forty-eight (48) square inches. For purposes of this section, "map module" shall be defined as a double-sided sign with a display not larger than six hundred forty-eight (648) square inches and includes a map of the bike share system and safety information.

    (3)

    Bike share stations may not be constructed without first obtaining any necessary construction permits required by the Cincinnati Municipal Code or any other applicable law.

    (4)

    Persons desiring to secure a revocable street privilege for the placement of a bike share station within the public right-of-way shall submit an application on a form to be provided by the city manager or his designee which shall:

    (i)

    Identify the name of the applicant;

    (ii)

    Identify the requested locations for the bike share stations;

    (iii)

    Identify the name and address of the person authorized to receive notices pursuant to Chapter 718 of the Cincinnati Municipal Code;

    (iv)

    Include proof of liability insurance for each bike share station in an amount not less than $1,000,000.00 which names the city of Cincinnati as an additional insured; and

    (v)

    Include a copy of the city's notice of award that the applicant's response to the city's request for proposals was selected as the "most advantageous" to the city.

    (5)

    Revocable street privileges for bike share stations shall expire upon the termination of the concession agreement with the city of Cincinnati and shall be revocable as set forth in Chapter 718 of the Cincinnati Municipal Code and as set forth in the bike share agreement.

    (6)

    Holders of revocable street privileges for bike share stations must maintain liability insurance in an amount not less than $1,000,000.00 at all times while the revocable street privilege is in effect. The city of Cincinnati shall be named as an additional insured. Proof of insurance shall be provided upon request. Failure to provide proof of insurance may result in the revocation of the revocable street privilege.

    (7)

    Revocable street privileges for bike share stations shall be revoked in the event the location ceases to be used as a bike share station. Bike share stations must be removed within sixty (60) days of revocation of the revocable street privilege.

    (c)

    Penalties. Whoever violates any of the provisions of Section 723-24, "Bike Share Stations," commits a Class C Civil Offense as defined by the Cincinnati Municipal Code § 1501-7(a), and is liable for the civil fine specified in § 1501-99 for a Class C Civil Offense. Additional violations or failure to pay fines will result in immediate revocation of the revocable street privilege.
