§ 721-146. Owner of Abutting Property to Maintain Sidewalk Encroachment.

  • (A)

    The owner or owners of land adjacent to a sidewalk encroachment are jointly and severally responsible for causing the sidewalk encroachment to be kept safe and in repair.

    (B)

    If the city manager determines that a sidewalk encroachment is an immediate safety hazard he may cause the abatement of the hazard by any reasonable means. In the case of such an emergency the city manager may enter the adjacent property and building to effectuate repairs. In such cases notice required by Section 721-149 is waived.

    (C)

    For purposes of enforcement, each day of nonconformance with Section 721-146 is a separate offense.
