§ 1101-11. Conformance.

  • 1101-11.1 General: No building or its equipment or appurtenances shall hereafter be constructed, installed, altered, relocated, repaired, removed, or changed in use except in conformity with the provisions of the CBC and any authorized rule or approval of the director of building and inspections made and issued thereunder.

    1101-11.2 Single, Two and Three Family Dwelling Houses: The provisions of the CBC are modified as follows:

    1101-11.2.1 Alternative Construction: The provisions of this code are not intended to limit the appropriate use, in single, two and three family dwelling houses, of materials, appliances, equipment or methods of design or construction not specifically prescribed by this code, provided the director of buildings and inspections determines that the proposed alternate materials, appliances, equipment or methods of design or construction are at least equivalent to those prescribed in this code in regard to suitability, quality, strength, effectiveness, fire resistance, durability, dimensional stability, safety and sanitation.

    Determination of equivalence shall be based on design or test methods or other such standards approved by the director. The director may require that evidence or proof be submitted to substantiate any claims of equivalency regarding a proposed alternate. The director may accept as supporting data to assist in this determination duly authenticated reports from the Building Officials and Code Administrators International, In.; Southern Building Code Congress International, Inc.; International Conference of Building Officials; the National Evaluation Service Committee of the Council of American Building Officials; and acceptance documents from the U.S. Department of Housing and Urban Development or other approved authoritative sources. The costs of all tests, reports and investigations required under these provisions shall be paid by the applicant.

    1101-11.2.2 Change of Use: Any existing residential building that is changed in use as a single, two and three family dwelling shall be required to comply only with 1101-11.2.3 and Chapter 1111 CBC.

    1101-11.2.3 Repairs, Alterations or Additions to Single, Two and Three Family Dwelling Houses: Repairs, alterations or additions to any single, two or three family dwelling house, shall conform to that required of a new structure, without requiring the existing structure to comply with those provisions of this Code for new buildings, provided conformance with Chapter 1117 CBC can be demonstrated. Repairs, alterations and additions shall not cause the existing structure to become unsafe, unsanitary, or adversely affect its performance.

    Alterations or repairs to a single, two or three family dwelling house which are structural or adversely affect any structural member or any part of the existing structure having a required fire-resistance rating shall be made with materials required for a new structure.
