§ 1101-09. Applicability.
1101-09.1 General: The CBC applies to all buildings and regulated improvements to structures or premises.
Exceptions to CBC other than Chapter 1109, Flood Plain Management and the Zoning Code:
(1)
Buildings owned by and used for a function of the United States government.
(2)
Buildings constructed by the State of Ohio or buildings constructed on land owned by the State of Ohio.
(3)
Existing buildings where their location, parts, equipment, and other items do not constitute a serious hazard unless otherwise regulated by the provisions of Chapters 1117 and 1119 CBC.
(4)
Buildings constructed in accordance with plans approved as being in conformance with the CBC as then in effect.
(5)
Buildings or structures which are incident to the use for agricultural purposes of the land on which said buildings or structures are located, provided such buildings or structures are not used in the business of retail trade; for the purposes of this section, a building or structure is not considered used in the business of retail trade if fifty per cent or more of the gross income received from sales of products in the building or structure by the owner or operator is from sales of products produced or raised in a normal crop year on farms owned or operated by the seller (see §§ 3781.6 and 3781.06.1 of the Ohio Revised Code).
(6)
Agricultural labor camps as defined in § 3733.41 of the Ohio Revised Code.
(7)
Buildings or structures which are designed, constructed, and maintained in accordance with federal standards and regulations and are used primarily for federal and state military purposes which the U.S. secretary of defense, pursuant to 10 U.S.C. Sections 18233(A) and 18237, has acquired by purchase, lease, or transfer, and constructs, expands, rehabilitates, or corrects and equips, such buildings or structures as he determines to be necessary to carry out the purposes of chapter 1803 of the U.S.C.
1101-09.2 Effect of Contract. The Cincinnati Building Code is applicable to all parties as herein specified. A contract between private parties shall not affect the parties' responsibilities under this Code.
