§ 1021-9. Operation and Maintenance of Facility.

  • (a)

    The operation of the facility shall be conducted totally within the boundaries of the facility and within the fence area described in the application for the license in Section 1021-5, License.

    (b)

    The operation of the facility shall be conducted in accordance with the following:

    (1)

    All fluids be drained from vehicles stored for more than 30 days, or prior to removal of any parts from the vehicle.

    (2)

    All vehicles be stored on an impermeable surface with appropriate containment prior to and during removal of fluids.

    (3)

    A stormwater management utility approved surface water control system shall be installed at the facility. All surface water shall be collected in this facility and disposed of as approved by the health commissioner.

    (4)

    Soil and/or surface water samples shall be taken at the facility where contamination is suspected. The samples shall be taken to a certified laboratory and tested for priority pollutants as defined in 40 CFR 126.26 or as determined by the health commissioner. The laboratory analysis shall be at the owner's expense. Treatment of the surface water runoff may be required before disposing outside the property.

    (5)

    The health commissioner may require the installation of ground water monitoring wells.

    (6)

    A record shall be kept on all fluids removed from vehicles determined to be hazardous, indicating proper disposal or recycling.

    (c)

    The operator shall take action: to control noise, dust, and odors that originate from the facility, so as not to cause a public nuisance, health hazard or air pollution. All facilities shall have vehicle cleaning apparatus to remove dirt and debris from the vehicle prior to the vehicle exiting the facility.

    (d)

    The operation of the facility shall comply with the Scrap Tire requirements of the Chapter 3734 Solid and Hazardous Waste of the Ohio Revised Code and any regulation adopted pursuant to such section and the waste tire provision of Section 3745-27-03 Exemptions of the Ohio Administrative Code.

    (e)

    Open burning not be conducted, permitted or allowed at a facility.

    (f)

    Open dumping, as defined in Chapter 3745-27-01 of the Ohio Administrative Code, shall not be conducted, permitted or allowed on a facility.

    (g)

    Solid wastes, infectious wastes, hazardous wastes, residual waste, sewage solids, semi-solids or liquid wastes shall not be accepted at a facility.

    (h)

    The operator shall exclude all domestic animals from the facility, except for dogs employed for security purposes.

    (i)

    The operator shall maintain the fence in good repair without rust or signs.

    (j)

    The operator shall maintain the area between the fence and street in a clean, litter and weed free manner.
