§ 1021-15. Closure of a Facility.

Closure of a facility shall be deemed to occur in the event of any of the following:

(a)

The operator declares the facility closed.

(b)

A license held by the operator expired, and no further license had been applied for in the manner prescribed.

(c)

A license held by the operator has expired, a license renewal has been applied for and denied, and all appeal procedures for such denial have either been exhausted or waived by timely failure to pursue such appeal procedures.

(d)

A license held by the operator has been suspended or revoked, and all appeal procedures for such revocation or suspension have either been exhausted or waived by timely failure to pursue such appeal procedures.

(e)

The initial application for a license for an existing facility is denied and all appeal procedures for such denial have either been exhausted or waived by timely failure to pursue such appeal procedures.
