§ 739-3. Use of the Central Riverfront.

  • The use of the central riverfront shall be preserved primarily for the peaceful and orderly enjoyment of the facilities, appurtenances and landscaping by the general public.

    The operating agencies for the central riverfront shall be the Cincinnati public recreation commission and the board of park commissioners for areas under their respective jurisdictions.

    Any special use of the central riverfront by a person, group of persons or organization shall not be permitted except in accordance with the terms of a permit issued by the wharfmaster with the approval of the appropriate agency or agencies.

    Special use shall include, but not be limited to, public meetings, music concerts, parades and races. All affected city departments including, but not limited to, the park board, the recreation commission, public utilities, public works and safety shall be notified by the wharfmaster before the permit is issued. The city of Cincinnati need not obtain a permit for use of the central riverfront, but must coordinate the use thereof through the wharfmaster.

    The following shall be a stipulation of all permits granted:

    (a)

    Groups, organizations or associations applying for a permit shall pay in advance the estimated reasonable costs of cleaning the central riverfront after the use and shall agree in writing to be responsible for repairing damage to the area, its appurtenances, facilities and landscaping which in any way arise out of the proposed use of the central riverfront.

    (b)

    Any person issued a permit to use the central riverfront under the authorization of this section shall have possession of the permit during such activity and show it upon request.

    This chapter shall provide the rules and regulations governing the use of the entire central riverfront to provide for the safety and protection of persons using the area pursuant to application for permit, the general public using the area and all public ways adjacent thereto, and the protection of the central riverfront itself, including all appurtenances, facilities and landscaping.

    Any permit issued pursuant to these rules may require the posting of bond or insurance policy and the hiring of off-duty Cincinnati police and/or park police officers to protect the public and the city of Cincinnati from any loss, injury or damage that may arise from such use. The wharfmaster shall supply forms to be used by groups, associations and organizations making application for the use of central riverfront in accordance with the provisions of this section.

    Rules included herein combine applicable, existing rules and regulations of the board of park commissioners and the public recreation commission and shall prevail over such existing rules and regulations in the event of conflict. Non-conflicting park board or recreation commission rules and regulations shall continue to have full force and effect in the appropriate areas of the central riverfront.

    Any violation of this section shall be deemed to be a minor misdemeanor for the first offense, and for a second or subsequent offense, a misdemeanor of the fourth degree.
