Chapter 721. STREETS AND SIDEWALKS, ESTABLISHMENT AND MAINTENANCE |
§ 721-103. Defect Caused by Encroachment.
Whenever any street or sidewalk shall become defective by reason of the failure of a property owner to properly maintain a private construction constituting an encroachment or street privilege within such street or sidewalk, the city manager shall be authorized to require the removal, repair or reconstruction of such encroachment by the owner, or to have the work done by the city in case of default, and to charge or assess against the owner any expense incurred by the city in connection therewith, in the same manner as provided in the case of the removal of interfering encroachments.
