§ 407-14. Emergency Revocation of License.

  • Whenever the city manager determines that the public safety is threatened by the continued operation of one or more public vehicles, the manager may immediately suspend the public vehicle license or licenses. In such a circumstance the safety director, or his designee, shall immediately notify the license holder who shall discontinue operation of the public vehicle or vehicles at once.

    Upon notifying the license holder of the emergency suspension, the director shall set a time and place for a hearing to determine if the suspension shall continue. Said hearing shall be conducted on the first business day after the order of suspension, unless the license holder requests a delay.

    If, at the hearing, the safety director determines that the public safety is not threatened he shall reinstate the license or licenses at no cost.

    If, at the hearing, the director determines that the public safety is threatened he may continue the license suspension or suspensions until such time as he determines that the public safety is no longer threatened.
