Chapter 324. MINORITY AND WOMEN BUSINESS ENTERPRISE PROGRAM |
§ 324-25. Requests for Waiver of Chapter Application for Sole Source and Emergency Acquisitions.
Unless the city manager or city purchasing agent determines that application of the provisions of this chapter to a particular contract is practical and in the best interest of the city, the provisions of this chapter do not apply to a particular contract if the city purchasing agent determines that:
(a)
there is only a single or sole source for the needed goods or services as provided in Section 321-85, 321-86, or any related sections of the Cincinnati Municipal Code; or
(b)
it is in the best interest of the city to procure compatible equipment accessories or replacement parts, original manufacturer for supplies, or public utility services, or to procure supplies for trial use or testing through a direct award as provided in Section 321-87 of the Cincinnati Municipal Code; or
(c)
the city purchasing agent makes a written determination that an emergency procurement is appropriate as provided in Section 321-89 of the Cincinnati Municipal Code.
