§ 306-65. Compensation of City Manager.

  • The compensation of the city manager shall be set by council. The annual salary shall be set by ordinance of council. The city manager shall receive all benefits provided to Division 5 executive employees with the following additional benefits or exceptions.

    (a)

    Transportation: The city will provide an automobile for use on city business including all operating and maintenance costs;

    (b)

    Vacation: The city manager shall be credited upon appointment with a balance of 160 hours of vacation and shall accrue vacation credit at the rate of 6.5 hours per pay period (approximately 21 days per year);

    (c)

    Sick Leave: The city manager shall be credited upon appointment with a balance of 480 hours of sick leave. Additional sick leave shall not accrue until the beginning of the third year of employment at which time it will accrue at the rate of 2 hours per week. The initial 480 hours shall not be used to compute sick leave buy-back until such time as the benefit would normally accrue to a Division 5 executive employee based upon pay periods worked and sick leave used;

    (d)

    Health Care Benefits: The city manager shall receive health care benefits which are the same or equal to those provided for Division 5 executive employees hired after January 1, 1985. They shall become effective immediately upon appointment;

    (e)

    Performance Review: At least one performance and salary review shall be conducted six months after appointment and annually thereafter;

    (f)

    Retirement: The city manager shall be enrolled as a member of the City Retirement System or the Ohio Public Employees Retirement System subject to applicable state laws and regulations;

    (g)

    Moving Expenses: The city shall pay actual and incidental expenses, including storage costs and insurance charges, for moving the city manager, his family and personal property from the San Francisco Bay Area to Cincinnati;

    (h)

    Transition Expenses: The city shall pay actual transportation costs for trips to Cincinnati and interim living expenses associated with relocation, not to exceed a total sum of $6,000;

    (i)

    Termination Benefits: In the event the city manager's employment is terminated other than for cause while he remains willing and able to discharge his duties as city manager, then, in that event, city shall pay a lump sum in cash of $70,000. For purposes of this benefit "termination" shall include involuntary resignation. For the six-month period following such termination, he shall provide consulting services as required for any transitional matters or litigation arising or pending during his term. Any associated expenses for such consulting services shall be paid by city. No obligation to pay this benefit shall arise if he voluntarily resigns or if the termination is for cause which shall include:

    (1)

    Willful and repeated neglect to perform the duties of city manager;

    (2)

    Conviction of any employment related criminal act;

    (3)

    Willful conduct, other than criminal, constituting a substantial violation of applicable standards of ethics; and

    (4)

    Conviction of any felony.
