§ 306-39. Police and Fire Death Benefit.

  • (a)

    Upon receipt of the proof of death of an active sworn employee of the Cincinnati Fire Division or retired member of the Police and Firemen's Disability and Pension Fund, including retired members from both the police division and fire division, whose death occurred subsequent to January 1, 1961, there shall be paid to the surviving spouse of such deceased member a death benefit of $1,000. If there is no surviving spouse, then the death benefit shall be paid to the estate of such deceased member.

    (b)

    Upon receipt of the proof of death of an active sworn employee of the Cincinnati police division or park police whose death occurred subsequent to December 23, 1978, there shall be paid to the surviving spouse of such deceased member a death benefit of $10,000. If there is no surviving spouse, then the death benefit shall be paid to the estate of such deceased member.
