§ 6. Zoning Board of Appeals.

  • There is hereby established a zoning board of appeals. The board shall have the duties and powers imposed by ordinance and this code. The board shall hear appeals from decisions and adjudications under the city's zoning regulations made by the zoning administrator, the property maintenance deputy, and other persons or administrative bodies authorized to administer and enforce the city's zoning regulations.

    The zoning board of appeals shall consist of seven members as follows:

    (a)

    One citizen member of the city planning commission on a revolving basis to be determined by the chair of the city planning commission;

    (b)

    One person engaged in the real estate, development, or construction industry;

    (c)

    One urban design professional or city planner;

    (d)

    One architect registered in the State of Ohio;

    (e)

    One attorney licensed in the State of Ohio; and

    (f)

    Two persons active in a community organization which is recognized by the council as a representative of a Cincinnati neighborhood.

    Members shall be appointed for three-year terms, provided that the city planning commission member shall be appointed by the chair of the city planning commission on a revolving basis.

    The city manager may appoint up to six alternates to the non-city planning commission members of the board for terms of three years each. An alternate member shall take the place of an absent or disqualified regular member at any meeting of the board according to procedures prescribed by the board. An alternate member shall meet the same appointment criteria as a regular member and shall only be designated to act in place of a similarly appointed regular member, i.e., the alternate architect filling in for the regular member architect. When attending a meeting on behalf of an absent or disqualified member, the alternate member may vote on any matter on which the absent or disqualified member is authorized to vote, shall be counted for purposes of quorum and shall have all of the rights and duties of a regular member.
