§ 5. Board of Building Appeals.

  • There is hereby established a board of building appeals. The board shall have the duties and powers imposed by ordinance and this code. The board shall hear appeals from decisions and adjudications by the chief building official arising under the Cincinnati building code, under revised code chapter 3781, revised code chapter 3791, and the rules made under them, including the Ohio building code and the residential code of Ohio, and under all other related building and housing codes, except in cases for which special boards of appeals have been provided to hear appeals of those decisions and adjudications.

    The board of building appeals shall consist of five members as follows:

    (a)

    One attorney, admitted to the Ohio bar;

    (b)

    One architect, registered in Ohio;

    (c)

    One structural engineer, registered in Ohio;

    (d)

    One mechanical engineer, registered in Ohio; and

    (e)

    One person representing organized labor, knowledgeable in the construction and equipment of buildings and structures.

    Members shall be appointed for five-year terms. The attorney, architect, structural engineer, and mechanical engineer members shall have recognized ability, broad training, and experience in problems and practice incidental to the construction and equipment of buildings and structures. Members shall continue in office subsequent to the expiration date of their term until their successor takes office or until sixty days have elapsed, whichever occurs first.

    The city manager may appoint up to five alternates to the regular members of the board of building appeals for terms of five years each. An alternate member shall take the place of an absent or disqualified regular member at any meeting of the board of building appeals. An alternate member shall meet the same appointment criteria as a regular member, and shall only be designated to sit in the place of the similarly appointed regular member, i.e. the alternate architect filling in for the regular member architect. When attending a meeting on behalf of an absent or disqualified member, the alternate member may vote on any matter on which the absent or disqualified member is authorized to vote, shall be counted for purposes of quorum, and shall have all of the rights and obligations of a regular member.
