§ 2. Membership of Administrative Boards.

  • The following provisions govern the terms of membership of the administrative boards established under this article, unless otherwise provided by state law or this code. All members shall be appointed by the city manager and confirmed by the council. Members shall be appointed for a specific term of years, and no member may serve more than two consecutive terms. Members shall be residents of the city and shall take an oath of office administered by the city solicitor or his or her designee at the beginning of each term. Members shall serve without compensation.

    Each member shall hold office from the date of appointment until the end of the term for which the member is appointed, provided that members shall continue in office subsequent to the expiration date of their term until their successor takes office. Members may be appointed to fill a vacancy occurring before the expiration of a member's term, and any member so appointed shall hold office for the remainder of the unexpired term.

    Members shall be removed by the city manager for misfeasance or malfeasance, including either of the following reasons: (i) failure to attend at least 75 percent of the regularly scheduled meetings in a calendar year; or (ii) upon a determination by the city manager, in consultation with the city solicitor, that, pursuant to the ethics requirements of the Ohio revised code, a member failed to disclose the existence of a conflict of interest and/or participated in consideration of a matter before the board which constituted a conflict of interest for that member.
