§ 00053-9. Housing.

(A)

In all buildings used or intended to be used for human occupancy, except one-family dwellings, the owner shall maintain the yard, cellar, courts, halls, attics, roofs, sheds, or other portions free from accumulations of dirt, filth, garbage, ashes, rubbish, or other waste materials in order to prevent rodent, insect, or other pest harborage. In all one family dwellings the occupant shall keep his yard, court, roof, cellar, attic, rooms, and all other portions clean and free from accumulations of ashes, rubbish, garbage, refuse, and any other waste materials in order to prevent rodent, insect, or other pest harborage.

(B)

The occupant, when moving to another location, shall leave the vacated premises in a reasonably clean condition. The owner shall, before renting a dwelling, place the premises in a reasonably clean condition.

(C)

No below-ground space, cellar, basement, or room which is damp, poorly ventilated or otherwise liable to predispose occupants to disease shall be occupied or permitted to be occupied for living or sleeping purposes.

(D)

It shall be unlawful for any person to maintain or permit to be maintained any room or rooms, occupied by human beings, in such filthy, dirty, or neglected condition so that the health of the occupant or occupants or the well-being of the community is endangered.

(E)

Each occupant shall keep the quarters of which he has sole use, including beds, mattresses, and other accessory objects clean and free from mice, rats, fleas, roaches, or other disease causing vectors.

(F)

In all buildings occupied by human beings, in which the use of a substantial part of the furniture or dishes or linens is included in the rental (furnished rooming houses), the person renting the rooms to the occupant shall maintain all rooms, stairs, halls, toilets and bath rooms including all fixtures, in a clean and usable order. The person renting the rooms to the occupant shall maintain the premises and furnishings in a clean condition, shall provide approved containers for all waste material, and shall properly store and remove such waste material.

(G)

Ceilings, floors, floor coverings and walls shall be present, intact and sanitary with no water damage or suspected mold.

(H)

The interior of appliances and equipment provided by the property owner shall be maintained in good repair, structurally sound and in a sanitary condition.

(I)

Occupants shall keep that part of the structure which they occupy or control in a clean and sanitary condition.

(J)

Every owner of a structure containing a rooming house, housekeeping units, hotel, a dormitory, two or more dwelling units or two or more nonresidential occupancies, shall maintain, in a clean and sanitary condition, the shared public areas of the structure and exterior property.
