§ 00053-7. Waste disposal.

(A)

It shall be unlawful to store waste containers so that odors, flies, or other pests prevent the use of doors, windows, and other openings for ventilation, or create a nuisance in neighboring premises.

(B)

It shall be unlawful to contain combustible or non-combustible waste materials in open cans, barrels, boxes, cartons, crates, or other unapproved containers that may provide a rodent, insect, or other pest harborage.

(C)

Lids shall be placed tightly on all rigid waste containers except during the time of depositing waste in the containers.

(D)

It shall be unlawful for any person to throw, deposit, let fall, or permit to accumulate any solid, hazardous, or infectious waste, rubbish, paper, cans, ashes, refuse, garbage, or putrescible organic matter, litter, junk, combustible or noncombustible waste, junk vehicles, or miscellaneous debris on any lot, yard, shed, roof, porch, or other such place. Any place used to store such materials must be designated as a "sanitary landfill" or a "licensed solid waste transfer station" as provided in Ohio Revised Code and licensed by the Cincinnati Health Department or zoned as a business to handle such material and operated according to the provisions of the regulations of the Cincinnati Board of Health and the Cincinnati Municipal Code. Stored materials shall be stacked neatly in piles elevated at least eighteen (18) inches above the ground or floor so as not to provide a rodent, insect or other pest harborage.

(E)

The owner of lots, yards, or other places littered with rubbish, paper, cans, garbage, ashes, refuse, or waste material of any kind shall cause said material to be removed.

(F)

Yard waste shall either be incorporated into the soil, household composted, converted into mulch or removed.

(1)

Household compost may consist of ground, shredded, or chopped yard waste, including, but not limited to, grass clippings, shrub trimmings, wood chips, leaves, herbaceous garden waste, brush, and other such plant derived materials.

(2)

No person shall create or maintain a household compost pile in such a manner that it becomes a rodent or insect harborage, or that it produces offensive and noxious odors, or that it causes any form of surface or groundwater pollution.

(3)

Household compost piles shall be located:

(a)

a maximum practical distance from any occupied structure;

(b)

five (5) feet from any auxiliary structure;

(c)

fifty (50) feet from any private water supply system;

(d)

five (5) feet from any lot line;

(e)

ten (10) feet from any roadway, alley, or other public right-of-way;

(f)

twenty (20) feet from any natural watercourse;

(g)

a household compost pile shall not be constructed in a natural wetland.

(4)

Household compost piles shall be maintained in a safe and sanitary manner. Household compost piles that produce offensive odors or that harbor insects or rodents shall be removed. Household compost piles shall have adequate natural drainage, such that any liquids generated by the decomposing yard waste shall be absorbed into soil.
