§ 1251-99. Penalty.

Whoever violates this chapter is guilty of a Class D Civil offense if the possession by the ward did not result in death or harm to an individual or damage to property. If the possession by the ward resulted in harm or death to an individual or damage to property then the offender is guilty of a fourth degree misdemeanor.
