Chapter 1233. FIRE SERVICE OUTSIDE CITY |
§ 1233-23. Contract for Township, Village or City Fire Protection.
With his report and recommendation in the matter of the application of a township, village or city for auxiliary fire protection, the city manager shall submit an ordinance to council authorizing the execution of a contract of fire protection between the city of Cincinnati and the applicant township, village or city. The proposed contract shall provide the following:
(a)
That the applicant township, village or city shall maintain a fire department adequate for its ordinary fire protection purposes, and shall call on the city for additional fire services only for a fire too large to be handled by one company or when its fire department is already engaged at a fire;
(b)
That the city of Cincinnati fire force shall answer all calls for fire service in the same manner and with personnel and equipment of the same kind as for similar fires within the city of Cincinnati;
(c)
That the contract shall in no event confer a right of action for damages either on the contracting township, village or city or on any property owner or resident thereof, for operation or failure to operate thereunder;
(d)
That the amount payable by the applicant township, village or city shall be equal to five mills per dollar of the total real estate tax duplicate value of such township, village or city for each year of the contract. If the period consists of or includes the fractional part of a year, the payments shall be proportioned as in the case of unincorporated fire protection districts;
(e)
The method and times of payment of the annual fire protection amount;
(f)
That no fire service shall be rendered where the applicant township, village or city is in default in the payment of amounts due under the contract;
(g)
Other special provisions that may be agreed on;
(h)
The contract shall not be effective until approved by the respective board of trustees, council or other legislative body.
