§ 1225-1. Smoking and Use of Open Flame Prohibited.

  • No person shall smoke or use an open flame in the following places or permit smoking or use of an open flame:

    (a)

    Where smoking or use of an open flame is prohibited by the Cincinnati fire prevention code;

    (b)

    Where conditions are such as to make smoking or use of an open flame a hazard;

    (c)

    In any retail store designed and arranged to accommodate more than 300 persons or in which more than 25 persons are employed, except as follows:

    (1)

    Specifically designated smoking and rest rooms where approved by the fire chief;

    (2)

    Restaurants, executive offices or beauty parlors located in retail stores;

    (d)

    In an elevator;

    (e)

    In or around any aircraft hangar, except in offices, waiting rooms or areas where approved by the fire chief;

    (f)

    In a hospital, sanitarium, rest home or other institutional building providing care for three or more persons, except as follows:

    (1)

    Patients classified as responsible may smoke in bed under the proper supervision of attendants;

    (2)

    Visitors, employees and patients may smoke in solariums and other areas specifically established for that purpose where approved by the fire chief;

    (g)

    In any building, portion thereof, or any open area, where quantities of flammable or combustible materials are present in amounts which constitute a hazard;

    (h)

    In any building, portion thereof, or any open area where a serious life safety hazard exists;

    (i)

    In any building, barn, vessel, boat or other place where highly flammable, highly combustible, or explosive materials are present;

    (j)

    In any place where the fire chief orders the posting of no smoking signs or the use of audio and/or visual notification that smoking or use of an open flame is prohibited.
