§ 1101-69. Vacated Dwelling Units Not to be Rented.

  • 1101-69.1 General: When the owner, person in control, or agent of a dwelling unit, fails to comply with an order of vacation issued by the director of buildings and inspections and allows the dwelling unit to be occupied by persons other than himself, such person shall be in violation of § 1101-65 CBC unless he can show by preponderance of the evidence that the property is being occupied without his knowledge or consent. Proper service of an eviction notice or the good faith maintenance of forcible entry and detainer proceedings against occupants shall be prima facie evidence of lack of knowledge and consent. The penalty for violation shall be as provided in § 1101-51.2 CBC.
