§ 1101-49. Revocation of Permits and Certificates.
1101-49.1 Revocation and refusal of permits: The director of buildings and inspections may revoke any permit, license, certificate or approval issued under the provisions of this Code, may refuse to issue a permit, license certificate, or approval or may stop the work for any of the following reasons:
(1)
Whenever there is a violation of any provision of this Code, any ordinance of the city or statute of the state relating to the same subject matter;
(2)
Whenever the continuance of any work or a condition of occupancy becomes dangerous to life or property;
(3)
Whenever there is a violation of any condition on which the issuance of the permit, license or certificate was based;
(4)
Whenever in the opinion of the director of buildings and inspections the person having charge of the work is incompetent;
(5)
Whenever any false statement or misrepresentation has been made upon the application, plans, or specifications on which the issuance of the permit, license, certificate or approval was based;
(6)
When orders on a building have not been complied with or when the building does not comply with the occupancy requirements; or
(7)
Whenever adequate water supply or facilities for firefighting purposes are not furnished as required in § 1101-15.4 CBC.
1101-49.2 Notice of revocation: The revocation notice of the permit, license, certificate or approval in every instance shall be in writing and shall be served upon the owner, his agent or the person having charge of the work. A revocation notice shall also be posted upon the building in question by the Director of Buildings and Inspections or the electrical inspection agency. After the notice is received or posted, it shall be unlawful for any person to proceed with any operation for which such permit was issued. No part of the fees for such permit shall be returned.
1101-49.3 Rescinding revocation fee: When any permit, license certificate, or approval is revoked because of the violation of any of the provisions of this Code, the fee for rescinding such revocation shall be as established under Section 1101-85.
