§ 1101-37. Certificate of Occupancy.

  • 1101-37.1 New buildings: A building or structure hereafter erected shall not be used or occupied in whole or in part until a certificate of occupancy shall have been issued by the director of buildings and inspections.

    1101-37.2 Buildings hereafter altered: A building or structure hereafter enlarged, extended or altered, in whole or in part, shall not be occupied or used until the certificate of occupancy shall have been issued; except that any use or occupancy which was not discontinued during the work of alteration shall require the issuance of a certificate by the director of buildings and inspections within thirty days after completion of the alteration.

    Exception: A certificate of occupancy shall not be required for alteration work to existing single family dwelling houses.

    1101-37.3 Existing buildings: Upon written request from the owner or person in control of an existing building or structure, the Director of Buildings and Inspections shall issue a certificate of occupancy, provided there are no violations of law or orders of the building official pending, and it is established after inspection and investigation that the alleged occupancy of the building or structure has heretofore existed. This Code shall not require the removal, alteration or abandonment of, or prevent the continuance of the occupancy of a lawfully existing building or structure, unless such occupancy is deemed to endanger public safety and welfare.

    1101-37.4 Changes of occupancy: A building or structure hereafter changed, in whole or in part, from one occupancy to another shall not be occupied for the new occupancy until the building conforms to the applicable provisions of this code for the new occupancy and the certificate of occupancy shall have been issued by the director of buildings and inspections for such changed portions.

    1101-37.5 Temporary occupancy: Upon the request of the holder of a permit, the director of buildings and inspections may issue a temporary certificate of occupancy for a building or structure, or part thereof, before the entire work covered by the permit shall have been completed, provided such portion or portions may be occupied safely prior to full completion of the building or structure without endangering life or public welfare.

    1101-37.6 Contents of certificate: When a building or structure is entitled thereto, the Director of Buildings and Inspections shall issue a certificate of occupancy. Upon completion of inspection and resolution of all pending orders, the certificate of occupancy shall be issued. The certificate of occupancy shall contain the following:

    (1)

    Statement certifying compliance with the provisions of all applicable codes.

    (2)

    The edition of the OBC or One, Two and Three Family Dwelling Code under which the plan approval was issued.

    (3)

    The plan approval application number.

    (4)

    The address.

    (5)

    A description of that portion of the structure for which the certificate is issued.

    (6)

    The use group(s) and occupancies(s), in accordance with the provision of "Chapter 3, Use and Occupancy Classification" OBC or Section 1115-01 CBC.

    (7)

    The type of construction as defined in "Chapter 6, Types of Construction" OBC.

    (8)

    The design occupant load.

    (9)

    If an automatic sprinkler system is provided, whether the sprinkler system is required.

    (10)

    The hazard classification or storage configuration, including aisle widths, for which the automatic sprinkler system is designed.

    (11)

    The automatic sprinkler and standpipe system demand at the base of the riser.

    (12)

    The classification of the subject property under the Cincinnati Zoning Code, including any applicable overlay district regulations.

    (13)

    Any special stipulations and conditions of the plan approval including any variances granted to the requirements of this code.

    1101-37.6.1 Validity of a certificate of occupancy: The certificate of occupancy represents an approval that is valid only when the building or structure is used as approved and certifies conformance with applicable provisions of the CBC, OBC and Chapters 3781 and 3791. of the Revised Code. The approval is conditioned upon all building systems and equipment being maintained and tested in accordance with applicable codes and applicable equipment and systems schedules.

    1101-37.7 Fee: The fee for a certificate of use and occupancy required by this code shall be established under Section 1101-85, and shall be payable at the time the permit is issued; or the case of a request for a certificate not associated with a permit, payment shall be made at the time of application.
