§ 1031-9. Acceptable Fill Material

  • Material is acceptable as fill for a site intended to be used for residential development if the material contains equal to or fewer parts per million of any contaminant than allowed under the Ohio Environmental Protection Agency's Voluntary Action Program generic direct-contact soil standards for carcinogenic and non-carcinogenic chemicals of concern for residential soils as found in OAC 3745-300-08. Material is acceptable as fill for a site intended to be used for commercial or industrial development if the soil contains equal to or fewer parts per million of any contaminant than allowed under the Ohio Environmental Protection Agency's Voluntary Action Program generic direct-contact soil standards for carcinogenic and non-carcinogenic chemicals of concern for commercial or industrial soils as found in OAC 3745-300-08.
