§ 1021-99. Penalties.

  • Whoever violates Section 1021-5 (a), License, of this chapter shall be guilty of a misdemeanor and shall upon conviction be fined not more than $1,000 or imprisoned not more than 90 days, or both. Each and every day on which such person continues to violate the provisions of this chapter after having been notified of such violation shall constitute a separate offense.

    No person shall be imprisoned under this section for the first offense, and the prosecution shall be as and for the first offense unless the affidavit upon which the prosecution is instituted contains the allegation that the offense is a second or repeated offense.
