§ 1001-19. Complaints, Investigations and Orders.

  • The city manager or his or her designee, including but not exclusively HCDES, is hereby designated to investigate complaints and make other investigations related to air pollution or air pollution nuisances in the city. The city manager, or his or her designee, may enter orders requiring compliance with the requirements of this chapter. The city manager, or his or her designee, including HCDES, may enter and inspect any property and records at any reasonable time for the purpose of ascertaining the state of compliance with the requirements of this chapter. If entry or inspection is refused, the city solicitor may apply to an appropriate court for a warrant or other order necessary to achieve the purposes of this chapter. Nothing contained in this chapter shall be construed to allow a search of any premises without a proper warrant where such is required by law.
