§ 885-4. Enforcement.

  • Complaints of a violation of Section 885-3 shall be made to the human services division of the city manager's office. The human services division shall designate an agency to investigate such complaints and, when the agency determines that it is probable that such practices have occurred or are presently in existence, to attempt to eliminate any such unlawful discriminatory practices by informal methods of conference, conciliation and persuasion.

    If the designated agency is unable to eliminate the unlawful discriminatory practice or obtain a conciliation of the complaint, notice thereof shall be given to the complainant. A civil action to enforce the terms of this chapter may be commenced by the complainant at any time within six months of the alleged unlawful discriminatory practice. If such civil action is brought prior to the completion of the designated agency's investigation and conciliation effort, then such effort may be discontinued within the discretion of the human services division of the city manager's office.
