§ 873-33. Operating a Moving Business With Unsatisfied Judgement Prohibited.

  • No moving business shall transport the household goods of another from and to any place exclusively within the city of Cincinnati, or from and to any place within the city of Cincinnati and from or to any place in a municipality immediately contiguous to the city of Cincinnati if such moving business has an unsatisfied judgment against it.

    For purposes of this section a person is deemed to have an unsatisfied judgment against him, if there is an unsatisfied judgment against any partnership, association, corporation, or other business entity and that person was a partner, officer, or director of the entity when the acts leading to the unsatisfied judgment occurred.

    Definitions

    "Moving business" means any person, partnership, association, or corporation engaged in moving the house hold goods of another from one residence to another residence with the intent of making a profit.

    "Unsatisfied judgment" means an unpaid, final, and unappealable order of any court in the United States against a moving business to pay a consumer money as a result of the moving business's action, error, or omission in the course of operating a moving business

    A violation of this section shall constitute a misdemeanor of the fourth degree.
