If a vendor fails to comply with any provision of this chapter, the vendee shall have
a cause of action against the vendor and may rescind the land installment contract
and may recover, for each such failure, the vendor's actual damages or $5,000.00,
whichever is greater, and reasonable attorney's fees for services performed, and the
costs of the action.
