Chapter 869. WRECKER AND TOWING OPERATIONS |
§ 869-5. Police Rotation List.
For the purpose of facilitating the removal of vehicles within the City limits which are illegally parked or which have been disabled, the City Manager or the City Manager's designee, is authorized to establish a police rotation list consisting of the names of locally owned wrecker operators who are able and willing to provide towing services for the city. To be eligible for participation in the rotation of wrecker operators on the police rotation list, a wrecker operator must:
(a)
have and keep in force general liability insurance, protecting against bodily injury and property damage, in an amount of not less than $1,000,000 with a deductible no greater than $1,000. Such insurance must contain an endorsement providing a minimum of ten days notice by the insurer to the City of Cincinnati prior to any material change or cancellation.
(b)
have garage keepers legal liability insurance, covering property which comes into the care, custody, or control of the wrecker operator, by virtue of towing, covering theft, fire and collision in an amount of not less than $100,000 with a deductible no greater than $500. Such insurance must contain an endorsement providing a minimum of ten days notice by the insurer to the City of Cincinnati prior to any material change or cancellation.
(c)
not have been convicted of one (1) or more charges under Ohio Revised Code Section 4513.60 or Section 869-11 of this chapter, or any successor statute or ordinance, within the previous twelve (12) months.
If, at any time, a wrecker owner or operator is removed from the police rotation list after being convicted of one (1) charge under Ohio Revised Code Section 4513.60 or Section 869-11 of this chapter, or any successor statute or ordinance, at least one (1) year shall elapse before the wrecker owner or operator may be eligible for the police rotation list.
If, at any time, a wrecker owner or operator is removed from the police rotation list and has two (2) or more convictions under Ohio Revised Code Section 4513.60 or Section 869-11 of this chapter, or any successor statute or ordinance, within the previous five (5) years, at least three (3) years shall elapse from the date of the last conviction before the wrecker owner or operator may be eligible for the police rotation list.
