§ 723-21. Removal of Structures.

  • Any structure placed in violation of any provision of this chapter is subject to removal by the city upon thirty (30) days' written notice to the owner, if known. Structures of which the owner is not known are subject to immediate removal. Removed structures shall be stored by the city and available for pick-up by the owner for a period of thirty (30) days following removal. Removal and storage costs shall be billed to the owner of the structure. Structures may be claimed by the owner only upon payment of the removal and storage costs. Structures not claimed within thirty (30) days of removal will be disposed of. Nothing in this section is intended to prohibit the assessment of any other penalties provided in this chapter or in any other chapter of the Municipal Code.

Ord. No. 363-2009, § 1, effective Jan. 16, 2010, repealed the former § 723-21 and enacted a new section as set out herein. The former § 723-21 pertained to abutting owner maintaining litter receptacles on sidewalk and derived from Sec. 702-11; Ord. No. 263-1963, eff. Sept. 6, 1963; and C.M.C. 723-21, eff. Jan. 1, 1972.
