§ 723-17. Awnings, Marquees and Projecting Signs.

  • (a)

    The city manager or his designee is authorized to grant revocable street privileges for the placement of awnings, marquees and projecting signs subject to the following restrictions:

    1.

    Awnings, marquees and projecting signs must be approved by the department of buildings and inspections.

    2.

    Awnings, marquees and projecting signs must be designed and constructed in accordance with the American Association of State Highway and Transportation Officials' "Standard Specifications for Structural Supports for Highway Signs, Luminaries, and Traffic Signals" using a fifty-year mean recurrence interval for wind loads.

    3.

    Awnings, marquees and projecting signs must have a minimum vertical clearance of eight feet (8') above the sidewalk (unless the awning or projecting sign includes electrical components), a minimum horizontal clearance of two feet (2') from the street curb line, and be in compliance with clearance requirements for all overhead utilities.

    4.

    Awnings, marquees and projecting signs that include electrical components must have a minimum clearance of ten feet (10') above the sidewalk.

    5.

    Awnings, marquees and projecting signs must be fully supported by the building with no vertical supports extending below the bottom of the canopy.

    (b)

    Persons desiring to obtain a revocable street privilege for placement of an awning, marquee or projecting sign shall submit an application on a form to be provided by the city manager or his designee which shall:

    i.

    Identify the name of the applicant;

    ii.

    Identify the proposed location of the awning, marquee or projecting sign;

    iii.

    Identify the name and address of the person authorized to receive notices pursuant to Chapter 718 of the Cincinnati Municipal Code;

    iv.

    Include written proof of approval of the awning by the department of buildings and inspections;

    v.

    Include a written statement signed and stamped by a professional engineer registered in the State of Ohio indicating compliance with the American Association of State Highway and Transportation Officials' "Standard Specifications for Structural Supports for Highway Signs, Luminaries, and Traffic Signals."

    (c)

    Revocable street privileges for awnings and projecting signs shall not expire but shall be revocable as set forth in Chapter 718 of the Cincinnati Municipal Code.
