§ 720-65. Adjustment of Charge, Appeal.

  • Persons who consider the charges applicable to their lot or parcel to be unjust or inequitable may apply to the utility engineer for adjustment thereof, stating in writing the grounds of the complaint. The utility engineer shall cause appropriate investigation thereof and report the findings and recommendations to the city manager or the city manager's designee for review. The city manager or the city manager's designee shall consider the complaint and the report and recommendation of the utility engineer, and determine whether an adjustment of the charges for any such lot or parcel is necessary to provide for the just and equitable application of the storm drainage service charge, and adjust such charge if appropriate.

    Notice and substance of the appeal shall be sent to the utility division within 15 days after receipt of the charge. The utility engineer shall have 30 days to investigate the matter. The city manager or the city manager's designee shall timely review and rule upon the appeal.
