§ 718-15. Termination of Revocable Street Privilege.

  • When a revocable street privilege shall terminate, whether by force of law, by action of the authorized city authorities, or by reason of abandonment of the permitted use, the holder shall immediately remove all private construction from the street area and make all necessary street and sidewalk restoration, under the supervision and subject to the approval of the city manager. In case of failure to remove and restore within a reasonable time, the city manager shall be authorized to make the necessary removal and restoration, and charge the expense thereof to the holder.

    In the case of underground pipes or similar underground construction, where the pipes or other equipment can be effectively sealed, and the existence of the private construction in the street, alley or way presents no difficulties, the city manager may waive the removal and instead authorize the necessary sealing. All pipes or equipment left in any street, alley or way shall thereupon become the property of the city.
