§ 703-7. Conditions for Granting Permit.

  • If the city manager is satisfied, after investigation, that there is no reasonable likelihood of injury or damage from the proposed blasting, the permit may be issued subject to the following conditions:

    (a)

    The applicant shall agree in writing to indemnify and save harmless the City of Cincinnati as to all damage, liability, claims or expenses of any kind, and to reimburse any private individual, firm or corporation for any loss or damage of any kind arising out of, or occasioned by, the proposed blasting.

    (b)

    The applicant shall furnish a bond or indemnity insurance, in such reasonable sum as the city manager shall fix, for the benefit of the City of Cincinnati and of any private person, firm or corporation who shall be injured or damaged by the proposed blasting. Such bond or insurance shall not be released as long as any claim shall remain undisposed of or unsatisfied. Satisfactory evidence that the applicant has contracted for, and is protected by, adequate insurance may be temporarily accepted at the time of issuing permit in lieu of a policy of insurance.
