§ 609-99. Penalties.

(a)

A violation of Section 609-3 of this chapter is a Class C1 Civil Offense as defined by Cincinnati Municipal Code Section 1501-8(d); and a person who violates this section is liable for the civil fine specified in Section 1501-99 for a Class C1 Civil Offense.

(b)

A violation of Section 609-9 of this chapter is a Class C1 Civil Offense as defined by Cincinnati Municipal Code Section 1501-8(e); and a person who violates this section is liable for the civil fine specified in Section 1501-99 for a Class C1 Civil Offense. Every thirty days in violation constitutes a separate and distinct offense.

(c)

Any civil fines collected under this chapter shall be deposited into a Tobacco 21 Fund for the health department to support enforcement of Chapter 609 and to be used for enforcement, community education, and compliance efforts towards state and local tobacco product sales and use laws.
