§ 609-3. Sale of Tobacco Products to Those Under Twenty-One Years of Age Prohibited.

  • Effective on and after December 1, 2019, no tobacco retailer shall themselves, or through any agent, employee, representative, or vending machine, do either of the following:

    (1)

    Give, sell or otherwise provide or distribute tobacco products to any person under twenty-one years of age.

    (2)

    Give, sell or otherwise provide or distribute tobacco products without viewing proof of age demonstrating the recipient is at least twenty-one years of age, except that no such verification is required for a recipient over the age of thirty. That a person appeared to be over the age of thirty shall not constitute a defense to a violation of this section.
