§ 609-3. Sale of Tobacco Products to Those Under Twenty-One Years of Age Prohibited.
Effective on and after December 1, 2019, no tobacco retailer shall themselves, or through any agent, employee, representative, or vending machine, do either of the following:
(1)
Give, sell or otherwise provide or distribute tobacco products to any person under twenty-one years of age.
(2)
Give, sell or otherwise provide or distribute tobacco products without viewing proof of age demonstrating the recipient is at least twenty-one years of age, except that no such verification is required for a recipient over the age of thirty. That a person appeared to be over the age of thirty shall not constitute a defense to a violation of this section.
