§ 508-4. Removal of Obstructing Vehicles.

  • (a)

    Whenever any police officer finds a vehicle standing upon a highway in violation of any of the provisions of Sections 508-1 and 508-3, such officer is hereby authorized to move such vehicle, or require the driver or other person in charge of the, vehicle to move the vehicle, to a position off the paved or improved or main traveled part of such highway.

    (b)

    Whenever any police officer finds a vehicle stopped or stalled for whatever reason on any highway, causeway or in any tunnel, whether attended or unattended, where such vehicle constitutes an obstruction to traffic, such officer is hereby authorized to move such vehicle or require the driver or other person in charge of the vehicle to move the same to a position where it will not obstruct or impede the flow of traffic, or if unattended, to provide for the removal of such vehicle to the nearest garage or other place of safety.

    (c)

    Whenever any police officer or other lawfully authorized enforcement officer finds a vehicle stopped or standing within the streetcar obstruction zone in violation of any of the provisions of Sections 508-1-B, such officer is authorized to take any of the following actions:

    (1)

    Move such vehicle;

    (2)

    Require the driver or other person in charge of the vehicle to move the vehicle to a position outside the streetcar obstruction zone;

    (3)

    If the vehicle is unattended, to provide for either:

    (A)

    The removal of such vehicle to the nearest garage or other place of safety; or

    (B)

    The impoundment of the vehicle as provided in Section 513-1 or Section 515-9(c).

    (d)

    The owner of the vehicle shall pay any cost involved for the relocation, removal, or impoundment of such vehicle and for any storage charge, as provided in Section 515-9 of the Cincinnati Municipal Code.
