§ 908-9. Menacing.

  • (A)

    No person shall knowingly cause another to believe that the offender will cause physical harm to the person or property of such other person or member of his immediate family.

    (B)

    Whoever violates this section is guilty of menacing. Except as otherwise provided in this section, menacing is a misdemeanor of the fourth degree. If the victim of the offense is a community policing volunteer, menacing is a misdemeanor of the first degree.

    (C)

    Definitions: For the purpose of this section, a "community policing volunteer" is a person who is a registered participant in a City of Cincinnati Police Department Volunteer In Police Service ("VIPS") program, including, but not limited to, Citizens on Patrol, Cincinnati Police Volunteer Surveillance Teams, and Community Problem Oriented Policing teams.
