§ 411-7. Special Powers Assigned to Wharfmaster.

  • The wharfmaster shall have special power to designate the mooring point of any and all watercraft at the public landing or any of the river termini of the streets hereinafter mentioned in this chapter, and may also, for the convenience of all vessels moored to the public landing or river termini and for the necessary use of the special route provided for oversized loads by Section 723-43, cause a vessel once placed to be changed to another location, or order off and cause to be removed all skiffs, canoes, rafts, etc., to make room for the convenient landing of any boat or barge, or other watercraft, subject to pay wharfage as herein provided. In cases of vessels moored under contracts with the recreation commission the wharfmaster shall exercise discretion and not require movement unless under emergency conditions. In order to effectually carry out the provisions of this chapter, and prevent and suppress all riots, disturbances and disorderly conduct at the river, the wharfmaster and subordinate officers are hereby vested with the powers and authority of police officers.

    No person shall resist or in any way aid or abet in resisting the wharfmaster or a subordinate officer while in the discharge of any of the duties of office, nor shall any person fail to comply with a lawful order of the wharfmaster or a subordinate officer.

    Failure to comply with a lawful order of the wharfmaster shall constitute a separate offense for each day that such failure continues.
