§ 407-151. Accessible Vehicle Driver Responsibilities.
(a)
All Other Requirements Apply. Drivers of accessible vehicles are subject to all of the requirements of this chapter and any other applicable state or federal law pertaining to public vehicle operators. In addition to all such requirements, drivers of accessible vehicles must comply with the requirements in this section.
(b)
Training Requirements. All accessible vehicle drivers must complete a training program approved by the director, and may not operate an accessible vehicle until they have accomplished the training, which must include at minimum the following topics:
(1)
All applicable responsibilities under local, state, and federal disability laws.
(2)
The safe use and operation of that accessible vehicle.
(3)
An accessibility training program, including boarding and de-boarding protocols, first person language, disability awareness, and etiquette.
(c)
Background Check. All drivers of accessible vehicles must have a thorough background check performed on them for suitability, including a criminal history and driver history check.
(d)
Civility. When operating an accessible vehicle, every accessible vehicle driver shall be civil and courteous, refrain from using profanity, and offer to assist any passenger when it is evident that the passenger is a person with a disability, elderly, or otherwise in need of assistance.
(e)
Assisting the Passenger's Entry, Exit, Stability. The driver of an accessible vehicle must assist passengers who are using wheelchairs or other mobility aids upon entry from the sidewalk to the vehicle and upon exiting from the vehicle to the curbside. The driver must also help to secure the passenger and wheelchair or other mobility aid within the vehicle.
(f)
Packages. The driver of an accessible vehicle must place packages and parcels of a passenger with a disability in the vehicle and secure them and must retrieve them for the passenger at the end of the trip.
(g)
Assist with payment. Upon a passenger's request, the driver must assist the passenger with completing payment, such as helping the passenger to access the credit card reader and counting cash aloud.
