§ 406-47. Appeal from the Director's Decision.

  • The refusal or failure of the director to grant a certificate of authority or permit under this chapter, and any act, order, rule, regulation or decision of the director under any sections of this chapter shall be subject to appeal to council by the motor transportation company to which the order relates; provided that such appeal is filed with the clerk of council within five days after the promulgation of such act, order, rule, regulation or decision.

    Pending such appeal, the act, order, rule, regulation or decision of the director complained of, shall be suspended and the council shall determine the question so appealed, not later than 30 days after the filing of such appeal. In case of the failure of council to determine the appeal within 30 days from the time of the filing thereof, the action of the director shall go into full force and effect.
