§ 402-25. Rental or Lease of Real Estate at Airports.

  • The city manager is hereby authorized to enter into contracts for lease or for rental of land areas and building spaces at Lunken and Blue Ash Airports.

    Leases for land areas with hangars set forth in this section may be entered into by the city manager with any person occupying such land area and having operated a permitted service for at least one year; leases may be made without competitive bidding for a lease term not to exceed 5 years, at rental terms no less than the minimum rental rates set forth herein. In the event contracts are not entered into at the minimum rental rates set forth herein, the lease or rental of land areas with hangars shall be by competitive bid.

    Any person desiring to rent land area or building space shall apply to the director for a permit. The holder of an annual permit shall have the right to renew the permit by making application for renewal no later than 30 days prior to expiration of a permit. Permits and renewals thereof shall be subject to the approval of both the director and the city manager and shall conform with all laws and ordinances of the city of Cincinnati now in force and effect or hereafter enacted. The holder of any permit shall obtain the approval of the director prior to making any changes in the premises which require a permit from the Department of Buildings and Inspections.

    A rental permit may be revoked by order of the city manager at any time for violation of any ordinance concerning Lunken or Blue Ash Airports and permits to use restaurant and refreshment space may be revoked for violation of any city ordinance or board of health regulation relating to such uses. Payments of rent shall be made monthly in advance except as specifically provided for in this section or in a lease agreement. Minimum monthly rentals are as follows:

    (a)

    Lunken Airport Land Areas with Hangars: Land areas with hangars are listed below by lease area number, which number pertains to a specific area and to facilities as set forth on a plat approved by and on file with the director.

     Terminal Building Air Carrier Operations:

    Provided, however, that the space on the second floor of the south wing of the terminal building may be rented for the sum of 30 cents per square foot per year to any non-profit aviation organization whose membership is open to aviators using Lunken Airport and whose principal purpose includes the development of aviation and the promotion of knowledge and skill in the art of flying.

    The aforesaid minimum rental rates for lease or rental of space in the terminal building do not include power, gas or water services.

    (b)

    Lunken Airport Terminal Building - First Floor.

    Restaurant and Refreshment Space: The minimum rental rate shall be $9.00 per square foot per year, plus $2.50 per square foot per year for the appurtenant basement space, payable monthly in advance, plus the monthly payment of a minimum of 4.75 percent of the gross income received during each month from the operation of the restaurant and refreshment business in such space which income exceeds the monthly charge for the occupancy based on the above annual square foot rates. The occupant under such permits shall submit to the director a sworn statement not later than the 10th day of each month showing the gross income during the preceding month and at the same time shall pay the portion of the percentage of income stipulated above, if any, indicated by such statement to have accrued. The rates specified for rental of restaurant and refreshment spaces do not include power, gas, water or light.

    (c)

    Blue Ash Airport Land Areas with Hangars:

    The operative date of the fees and rentals contained herein shall be January 1, 1964.
