§ 324-31. Preference Points for Professional Services Prime Contracts.

(a)

An MBE or WBE that submits a response to an RFP or RFQ for a professional services contract may be awarded up to ten evaluation preference points.

(b)

Preference points for joint ventures that include certified MBE or WBE participants must be allocated on a pro rata basis in the same proportion to which a clearly defined portion of the work to be performed by the MBE or WBE with its own forces and equal to its share in the ownership, risks, performance, management and control of the joint venture bears to the total work to be performed under the contract.
