§ 101-43. Public hearing prior to imposition of new fees or charges.

  • (a)

    Not less than ten days before the adoption by city council of any ordinance imposing new fees or charges on the citizens of Cincinnati, council or a committee of the council designated by council shall hold a public hearing on the subject matter of the proposed ordinance. Notice of the time and place of the public hearing and the text of the proposed ordinance shall be published in the city bulletin for two consecutive weeks within the thirty day period immediately preceding the public hearing. The council, after having conducted or reviewed the substance of the public hearing, may adopt the proposed ordinance in whole or in part, or may decline to adopt the proposed ordinance.

    (b)

    This section shall not be construed to require a public hearing prior to modifying any fees or charges in effect on the effective date of this section, or fees or charges that the city manager has been authorized by ordinance to fix or modify.

    (c)

    This section shall not be construed to require a public hearing prior to the imposition or modification of a schedule of civil or criminal fines or penalties assessed against citizens for the violation of any provision of the Cincinnati Municipal Code.

    (d)

    In the event that any ordinance is modified by operation of law or is declared to be unconstitutional, the modification of the provisions of the ordinance to conform to the requirements of law or judicial decision shall not be subject to the public hearing requirement set forth herein.
