Appendix 00083. Regulation of Smoking in Public Places. |
§ 00083-7. Responsibility of proprietors.
The proprietor or other person having control of a place within Section 00083-1 (a) through (i) shall:
(a)
Provide a seat in a nonsmoking area in accordance with Section 00083-1 for all persons requesting such a seat;
(b)
Prominently post "SMOKING" or "NO SMOKING" signs, whichever are appropriate, with letters of not less than one inch in height, or the international "NO SMOKING" symbol consisting of a pictorial representation of a burning cigarette enclosed in a red circle with a bar across it. The owner, operator, manager, or other person having control of such building or place shall clearly, sufficiently, and conspicuously post in every room, building, or other place where smoking is regulated by this regulation.
(1)
Every theatre owner, manager, or operator shall post signs conspicuously in the lobby stating that smoking is prohibited within the theatre or auditorium, and in the case of motion picture theatres, such information shall be shown upon the screen for at least five seconds prior to the showing of each feature motion picture.
(2)
Every restaurant will have posted at its entrance a sign clearly stating that a nonsmoking section is available, and every patron shall be asked as to his or her preference.
(3)
Every public portion of grocery stores and food markets are required to have posted "NO SMOKING" signs at specific locations throughout each market as follows: Signs must be visible to people entering the market, people at meat and produce counters, and people in all checkout lanes.
(c)
Request persons smoking in violation of this act to stop.
(d)
In any dispute arising under this regulation, the rights of the nonsmoker shall be given preference.
