§ 00011-17. Variances.

(A)

The Health Commissioner may grant a hearing to a person and may authorize, in specific cases, such variance from the requirements of this regulation as will not be contrary to the public interest, and where the person shows that because of practical difficulties or other special conditions the application of this regulation will cause unusual and unnecessary hardship. However, no variance shall be granted that will defeat the spirit and general intent of this regulation, or otherwise not be in the public interest.

(B)

Any person objecting to the decision of the Health Commissioner pursuant hereto shall have the right to appeal such decision to the Board of Health.
