PREFACE
This Code constitutes a republication of the general and permanent ordinances of the City of Cincinnati, Ohio.
Source materials used in the preparation of the Code were the 1945 Code, republished in 1990, as supplemented through Ordinance No. 41-2002, adopted February 13, 2002, and ordinances subsequently adopted by the City Council.
These volumes contain the charter of the city of Cincinnati, the administrative code, the zoning code, the regulations of the independent boards and commissions and the income tax regulations. Following each section is the history thereof. If the section was part of the 1956 recodification, reference is made to the corresponding section in the 1956 edition of the Code of Ordinances by the abbreviation C.O. Sections adopted between the 1956 Code and the 1972 recodification of the Cincinnati Municipal Code state the number of the section as adopted using the abbreviation Sec. with the enacting ordinance number. If the section was adopted subsequent to the 1972 recodification, reference is made to the Cincinnati Municipal Code section adopted using the abbreviation C.M.C. with the enacting ordinance number. The history also contains references to ordinances amending the section, other sections bearing upon the operation of the section, and occasional references to related statutes and cases which interpret, limit or affect the section. The code provisions were substantially renumbered in the 1972 recodification effective January 1, 1972 and therefore the history note of each section reflects whether the section was reordained with the same number or renumbered.
For convenience in locating corresponding sections in the Cincinnati Municipal Code and the 1956 Code of Ordinances, tables are included which set forth in numerical order the Code of Ordinance section numbers with parallel references to the Cincinnati Municipal Code and Cincinnati Municipal Code numbers with parallel references to the Code of Ordinances. A table of ordinances and their corresponding section numbers adopted after the publication of the 1956 edition of the Code is also included.
The text of Chapter 307, Classified Compensation Schedules, has been deleted from this publication of the code. The chapter numbers, divisions, and titles are retained and an official record of these sections is available in the office of clerk of council for public examination and reference. These sections relate specifically to city employees' compensation rates, and experience has shown that they are subject to frequent modification and supplementation. Accordingly it was determined to omit them because of their limited usefulness and frequent obsolescence.
Chapter and Section Numbering System
The chapter and section numbering system used in this Code is the same system used in many state and local government codes. Each section number consists of two parts separated by a dash. The figure before the dash refers to the chapter number, and the figure after the dash refers to the position of the section within the chapter. Under this system, each section is identified with its chapter, and at the same time new sections can be inserted in their proper place by using the decimal system for amendments.
Page Numbering System
The page numbering system used in this Code is a prefix system. The letters to the left of the colon are an abbreviation which represents a certain portion of the volume. The number to the right of the colon represents the number of the page in that portion. In the case of a chapter of the Code, the number to the left of the colon indicates the number of the chapter. In the case of an appendix to the Code, the letter immediately to the left of the colon indicates the letter of the appendix. The indices have been prepared with the greatest of care. Each particular item has been placed under several headings, some of which are couched in lay phraseology, others in legal terminology, and still others in language generally used by local government officials and employees. There are numerous cross references within the indices themselves which stand as guideposts to direct the user to the particular item in which the user is interested.
Looseleaf Supplements
A special feature of this publication is the looseleaf system of binding and supplemental servicing of the publication. With this system, the publication will be kept up-to-date. Subsequent amendatory legislation will be properly edited, and the affected page or pages will be reprinted. These new pages will be distributed to holders of copies of the publication, with instructions for the manner of inserting the new pages and deleting the obsolete pages.
Keeping this publication up-to-date at all times will depend largely upon the holder of the publication. As revised pages are received, it will then become the responsibility of the holder to have the amendments inserted according to the attached instructions. It is strongly recommended by the publisher that all such amendments be inserted immediately upon receipt to avoid misplacing them and, in addition, that all deleted pages be saved and filed for historical reference purposes.
The City Bulletin, published by the clerk of council under the authority of council of the city of Cincinnati, sets forth the full text of all ordinances passed by the council. It is available at the office of the clerk or may be subscribed to on an annual basis.
